1. Hire Agreement
1.1 This agreement is between Hawthorn Farm Cottages and the "Hirer".
1.2 The Hirer agrees to hire the consulting/therapy rooms located in Foxglove Cottage, Hawthorn Farm, Corner Drove, Ware, Ash, Canterbury, CT3 2DB for the purpose shown in the Hire Agreement e.g. consultations, therapy sessions, workshops etc.

2. Hire Period
2.1 The Hire Period shall be as agreed in the Hire Agreement, these will be shown as Half Days, Full Days or Evening Hire.
2.2 The Hirer may extend the Hire Period, subject to availability and prior agreement with the Hawthorn Farm Cottages.
2.3 The Hirer shall not sublet the room to any third party.

3. Payment
3.1 The Hirer shall pay Hawthorn Farm Cottages the Agreed Hire Fee shown in the Hire Agreement upon booking the rooms/cottage.
3.2 Payment in full of the Hire Fee confirms the booking and reserves the dates for the Hirer.
3.2 Payment can be made by bank transfer or credit/debit card.

4. Use of the Rooms/Cottage
4.1 The Hirer shall use the Rooms/Cottage solely for the agreed purpose.
4.2 The Hirer shall not use the Rooms/Cottage for any illegal or immoral activity.
4.3 The Hirer shall not cause any damage to the Rooms/Cottages or its contents.
4.4 The Hirer shall not disturb other occupants of Hawthorn Farm in the adjacent cottages and the farmhouse.
4.5 The hours of use of the Cottage/Rooms:
      Half day hire: 4 hours (From 9am to 1pm or from 1.30pm to 5.30pm)
      Full day hire: 8 hours (From 9am to 5pm)
      Evening hire: 3 hours (6pm to 9pm)
4.6 The Hirer and/or their clients shall not stay in the rooms/cottage overnight.
4.7 The Hirer must vacate the rooms/cottage within 15 minutes of the end time of their Hire Period.
4.8 If the rooms/cottage is booked for consecutive full days the Hirer will be permitted to leave their own property and any equipment in the cottage for the duration of the Hire period.
4.9 The Hirer shall at the end of their use of the rooms/cottage return any furniture or equipment that may have been moved into its original positions in the cottage, put any crockery and cutlery to wash in the dishwasher, empty any bins, and leave the cottage in a clean and tidy condition.
4.10 The Hirer must ensure that the rooms/cottage are left securely locked at the end of their Hire Period and Keys returned.

5. Smoking
5.1 Please note that in accordance with current legislation, smoking is not permitted in any of our cottages. If the Hirer or their clients would like to smoke outside, you should use the ashtrays provided, as carelessness with cigarettes can cause considerable damage.

6. Insurance
6.1 The Hirer shall be responsible for insuring their own property and any equipment brought into or left in the rooms/cottage.

7. Cancellation
7.1 If the Hirer cancels the booking, the following cancellation fees will apply:
      Cancelling More Than 14 Days in Advance - No Cancellation Fee
      Cancelling Less Than 14 Days in Advance - 100% of the Hire Fee

8. Liability
8.1 The Hirer shall be liable for any damage caused to the Cottage/Rooms or its contents by the Hirer or their clients.
8.2 The Hirer shall indemnify Hawthorn Farm Cottages against any claims or liabilities arising from the Hirer's use of the Cottage/Room.
8.3 Neither party shall be liable to the other for any indirect loss, including but not limited to loss of goodwill, loss of business, loss of anticipated profits or savings and all other pure economic loss arising out of or in connection with this Agreement.

9. Damages Deposit
9.1 A damages deposit of £250 will be pre-authorised on your credit card upon arrival. This deposit will be held as security against any damage caused to the rooms/cottages or its contents during your stay. The pre-authorisation will be released within 7 business days of your departure, provided no damages are found.
Please note that this is a pre-authorisation, not a charge. No funds will be debited from your account unless damage needs to be repaired.

10. Confidentiality
10.1 In order to process your booking, we will need you to provide certain information about yourself and your visitors. We may use names, addresses and email addresses for sending you future promotional or marketing literature, however we guarantee that any information will remain confidential to us and is protected under the Data Protection Act 2018. Any personal information and details collected by us will not be passed on to a third party unless it is to one of our representatives in relation to looking after your specific booking.

11. Force Majeure
11.1 Both Hawthorn Farm Cottages and the Hirer will not be liable for our respective obligations under this agreement in circumstances amounting to Acts of God. An Act of God means any unusual and unforeseeable events beyond our control, including but not restricted to war, threat of war, civil strife, natural or nuclear disaster, fire, epidemics, terrorist activity and governmental action. The Hirer and Hawthorn Farm Cottages shall only be able to rely on Acts of God after taking all practical steps to remedy the cause and/or mitigate the effects of Acts of God.

12. Governing Law
12.1 The contract between the Hirer and Hawthorn Farm Cottages is governed by English Law. Any dispute you have with us shall be dealt with in an English or Welsh Court of Law. Your statutory rights are not affected by anything contained within these terms and conditions.
